END USER LICENSE AGREEMENT
Positive Prevention PLUS, a California limited liability company (the "Company"), is endorsed and authorized by the authors of the Positive Prevention PLUST Independent Study Curriculum (the "Curriculum") to deliver quality instructional materials. The Curriculum offers evidence-based instruction in comprehensive sexual health education, teen pregnancy prevention, and HIV/AIDS prevention education that is compliant with the California Education Code (collectively, the "Materials"). The Curriculum should be presented only to an age-appropriate audience of students and adults, in a school or alternative educational program site setting, and presented as written, consistent with California law. Additional information about the Company's policies is available in its Privacy Policy and Terms of Use (collectively, the "Policies") posted on the Company's Web site(s) and updated from time to time. As provided in this End-User License Agreement (the "License), unauthorized use of the Curriculum includes, but is not limited to, duplication and distribution of the copyrighted Curriculum and/or Materials without the Company's prior written consent, exclusion or modification of Curriculum content inconsistent with California law, and/or use of the Curriculum for personal gain such as representing oneself as an authorized trainer or educator on a fee for service basis without the Company's prior written consent. Further, the terms and conditions contained in the Policies are incorporated into this License by this reference. By clicking "I Accept" below, using the Curriculum, and viewing the Materials, you acknowledge and agree to the following: 1. You or your school/district has paid a subscription fee for access to and a limited license to use the Curriculum and view the Materials during the term of the license. The Curriculum and Materials shall be used for educational purposes only. 2. You accept from your school/district a limited, non-exclusive sublicense to use the Curriculum and the Materials on a single computer controlled by you. You may view and/or download only specifically designated Materials for your personal use in conjunction with your coursework. At all times, the Company shall retain ownership of the Curriculum, the Materials and any trademarks or service marks contained therein. All rights not specifically granted herein are reserved by the Company or the authors. 3. You will not share the login information (username and password) with any third party. If you are a student, you will not share the Curriculum or the Materials with anyone other than your teachers, parents and/or guardians. If you are an authorized instructor, you will not share the Curriculum or the Materials with any third party and you will use the Curriculum and the Materials only in the manner authorized by your school/district. 4. You understand (a) the content of the Curriculum is provided in an educational context at the direction of your school/district, and (b) the Materials are sexually descriptive and/or graphic in nature and should only be used in the manner intended. 5. Except as otherwise provided in this License, you may not reproduce, retransmit, disseminate, sell, distribute, perform, display, publish, broadcast, circulate, create derivative works from, or commercially exploit the Curriculum and the Materials, in whole or in part, in any manner without the prior written consent of the Company, nor use the content or information made available in the Curriculum or Materials for any unlawful purpose. 6. This License will terminate automatically, without notice from the Company or any judicial resolution, if you or your school/district fails to comply with any provision of this License, which includes, but is not limited to, any unauthorized use of the Curriculum and/or the Materials. Further the Company reserves the right to terminate this License for any reason upon thirty (30) days' prior written notice to you or your school/district.
